TOMS RIVER, OCEAN COUNTY – A Toms River man was sentenced this morning for endangering the welfare of children, in connection with the 2013 fatal shooting of a 6-year-old boy by the defendant’s 4-year-old son, Atlantic County Prosecutor Jim McClain announced today.
Anthony R. Senatore, 35, of McCormick Drive, Toms River, NJ, was sentenced this morning by Ocean County Superior Court Judge Wendell Daniels to 3 years of incarceration in New Jersey State prison for Endangering the Welfare of his own children, and of the 6-year-old neighbor, Brandon Holt.
On April 8, 2013, Senatore’s 4-year-old son gained access to an unsecured loaded .22 caliber rifle in Senatore’s bedroom and fired a single shot that struck 6-year-old neighbor, Brandon Holt, in the head. Holt was transported to the Jersey Shore University Medical Center, where he was pronounced dead the next day.

Following Holt’s death, the New Jersey Office of the Attorney General – Division of Criminal Justice directed the Atlantic County Prosecutor’s Office to supersede the Ocean County Prosecutor’s Office and take over the investigation into the circumstances surrounding the shooting.

Concluding a month-long investigation by this Office, Senatore was arrested on May 13, 2013, charged with 6 counts of Endangering the Welfare of Children:
  • 1) one count each for the five unsecured firearms found accessible to his own children, for whom he has a legal duty of care—a 2nd degree offense, and
  •
  • 2) one count of Endangering the Welfare of Brandon Holt, for keeping a loaded .22 caliber rifle unsecured in a bedroom where his 4-year-old son was able to access and fire the weapon—a 3rd degree offense.
The charges allege that, in addition to the loaded .22 caliber rifle used to fire the fatal shot, a Stevens 12-gauge shotgun, two Harrington & Richardson shotguns and a Remington 12-gauge shotgun were all found unsecured, in close proximity to ammunition and accessible to Senatore’s own children, ages 12, 8 and 4.
Senatore was lodged in the Ocean County Jail in lieu of $100,000 cash or bond bail set by Atlantic County Superior Judge Kyran Connor. Senatore later posted bail and was released.
On September 25, 2013, an Ocean County Grand Jury indicted Senatore on all six counts.
On October 30, 2014, Senatore pled guilty in Ocean County Superior Court to one count of 2nd degree Endangering the Welfare of Children for causing harm to the children for whom he has the legal duty of care, and to the 3rd degree Endangering the Welfare of Children charge for the harm done to Brandon Holt.
Today, pursuant to a negotiated plea agreement, Judge Daniels sentenced Senatore on each count to a term of incarceration in New Jersey State prison of 3 years, the sentences to run concurrently. Upon motion by the State, Judge Daniels ordered Senatore to transfer ownership of his weapons to a family member and surrender his firearms purchaser ID card.
At the conclusion of sentencing, Senatore’s bail was revoked by Judge Daniels, and he was placed in custody and lodged in Ocean County Jail for later transfer to state prison.
First Assistant Prosecutor Diane Ruberton of the Atlantic County Prosecutor’s Office represents the State in the matter.

Former Galloway Principal John Gibson now center of Lawsuit Filed Against Prosecutors Office

A lawsuit recently filed by Walter Luers, Esq., on behalf of John Paff, against the Ocean County Prosecutors Office (OCPO) may soon bring additional answers to questions that have lingered for almost a year.  The lawsuit is online here.

Those questions are pointed as to what happened with Galloway principal John Gibson that he abruptly began paid leave absences from work and then later retired without again, according to payroll records, stepping foot back in the school district.

According to Paff's website which has recorded the lawsuit filed, "The Ocean County Prosecutor's Office (OCPO) has acknowledged that it had prepared a June 6, 2014 investigation report into allegations made against John Gibson.  The OCPO also acknowledged that Gibson was interviewed at the Little Egg Harbor Police Department on January 27, 2014, only a few days before Gibson took his leave of absence.  According to the prosecutor's December 8, 2014 letter that denied access to both the investigation report and the video of the interview, the interview regarded "Mr. Gibson's involvement with a minor."

In May 2014, the Ocean County Prosecutors Office confirmed via a response to an Open Public Records (OPRA) request to Paff that "this office cannot release the contents of this file without a protective court order after an incamera review and a finding of "good cause" by the Court. See N.J.S.A. 2A: 82-46(c), which after further research of the NJ Law Library pertaining to that particular statute it explains an exemption regarding disclosure of documents pertaining to "child victims of crime of abuse".

The letter to Paff came after an initial OPRA request and email response on April 29, 2014 by the OCPO to Paff. According to Paff, the OCPO offered and further confirmed in their response, that an incident occurred in Little Egg Harbor Township, NJ that involved the Galloway Principal even though Paff's request did not mention any specific town.

On March 1, 2014, Galloway Township News was the first news agency to report the absence of a Galloway Township Public School Principal that caused great concern within the parental community of Galloway Township.

Also according to Paff's website which has blogged additional information regarding Gibson, he "has been receiving monthly net pension checks of an undisclosed amount since May 1, 2014.  Before deductions, however, the gross monthly pension amount is $7,834.50."Report Online Here.

The lawsuit is pending in New Jersey Superior Court.

Assemblyman Vince Mazzeo
Mazzeo/Bell to focus on relieving the property tax burden, creating jobs & investing in Atlantic County

(Atlantic County, NJ) -- Assemblyman Vince Mazzeo (D-Northfield) and Atlantic County Freeholder Colin Bell (D-Margate) formally announced their candidacies for the New Jersey General Assembly in the 2nd Legislative District.

In just his first term in the Assembly, Mazzeo has been on the forefront of fighting to lower the property tax burden on Atlantic County's middle-class families and seniors. He's fought for smaller, smarter government by championing shared services and consolidation.

Mazzeo recently authored a legislative package working towards the economic stabilization of Atlantic City - an effort that will lead to new investment and more jobs in our region has been lauded by both Democrats and Republicans as "the plan that will stop the bleeding in Atlantic City." Mazzeo was also the prime sponsor of the Economic Opportunity Act, a law that will bring hundreds of millions in tax incentives for businesses to locate and add jobs to our region.

"As a small business owner, I see firsthand the economic challenges and hard times facing Atlantic County, and have made it my top priority to improve affordability, lowering our tax burden and creating an environment to jump start job creation," said Mazzeo. "I'm extremely proud of legislation that I've championed to move our region forward, and know that together with Colin Bell we will promote sound fiscal policies and lead the fight to provide meaningful property tax relief."

Freeholder Colin Bell
Freeholder Bell, a local attorney and former Assistant Atlantic County Prosecutor was elected countywide in 2012 to the Atlantic County Board of Chosen Freeholders.  As a freeholder, Bell has been a constant defender of openness and transparency - changing the way business is done in Atlantic County. Thanks to his efforts he overturned county laws that delayed disclosure of public comments and public access to legislation pending before the board. Bell was also the only vote against repealing the state's toughest play-to-play law, an effort championed by Republican Freeholders when it was first adopted in 2007. Furthermore, his efforts to create jobs for veterans through a veterans' set aside programs and his work to make Atlantic County government more transparent have been lauded by the Press of Atlantic City.  Bell has long been active in the community serving on the Board of Directors for the Atlantic City Boys & Girls Club.

"I am honored to be running with Vince Mazzeo to continue serving our region," said Bell. "Vince and I share the same vision for Atlantic County - lower property taxes, more jobs and growing our economy by investing in small businesses. On the Freeholder Board, I've fought to cut government spending and stood up against partisan politicians who voted to repeal the toughest pay-to-play ordinance in the state." Bell added, "The last thing Trenton needs is more politicians willing to pave the way for special interests at the expense of Atlantic County's hard-working families."
