ATLANTIC COUNTY —A Linwood man was indicted today in connection with the assault on an Atlantic City police officer in 2013, Atlantic County Prosecutor Jim McClain announced.
This morning, Tuesday, January 20, 2015, an Atlantic County Grand Jury indicted David Connor Castellani, 22, of the 1000 block of Woodland Boulevard, Linwood, NJ, on three (3) criminal counts in connection with the June 15, 2013 assault of an Atlantic City Police Officer while the officer was in the performance of his duties. Castellani was indicted for:
  • Aggravated Assault on a Police Officer—a crime of the3rd degree, Resisting Arrest with threats or use of force or violence—a 3rd degree crime, and Inflicting Harm on a Law Enforcement Animal—a 4th degree crime.

On June 15, 2013 at approximately 2:40 a.m., Atlantic City police officers were called to Tropicana Casino for a report of violent and disorderly behavior. After arrival, David Castellani was issued a summons complaint for disorderly conduct, and released.

The State alleges that Castellani was on foot on Morris Avenue a short time later, when he threatened and used force against Atlantic City Police Officer Darrin Lorady, resisted the efforts of Lorady and additional police officers to effect his arrest, and purposely inflicted harm upon the Atlantic City police K-9 dog that was deployed to assist in that arrest.

Castellani was subdued, arrested, charged for the offenses, and later released on his own recognizance.

Today, the Grand Jury returned a true bill on all three counts.

Pursuant to an internal affairs complaint filed by David Connor Castellani, the Grand Jury was also presented evidence relating to the propriety of police use of force used during the arrest. The Grand Jury declined to indict the officers on any charges.

Due to the fact that an indictment has been returned against Mr. Castellani, the New Jersey Judiciary Rules of Professional Conduct—specifically RPC 3.6 and 3.8(f)— preclude this office from making any further comment on the factual circumstances which resulted in the grand jury’s decision to charge Mr. Castellani and to not charge any of the officers involved in the incident.

The only further comment that this agency can make at this time is that the grand jury heard all relevant evidence regarding this matter and received the proper instructions regarding the law governing the use of force by police officers.

A crime of the 3rd degree carries a potential sentence of 3 to 5 years of incarceration in New Jersey State prison. A 4th degree crime carries a potential prison sentence not to exceed 18 months.

First Assistant Prosecutor Diane Ruberton represents the State in the matter.

This charge is merely an accusation and not proof of guilt. In all criminal cases, a charged defendant is presumed innocent unless and until proven guilty.

MAYS LANDING – An Atlantic City Police officer pled guilty today to official misconduct for exploiting his position as a police officer in order to sexually assault a child, Atlantic County Prosecutor Jim McClain announced.
On Monday, May 19, 2014, as a result of an investigation by the Atlantic County Prosecutor’s Office Special Victims Unit, with the assistance of the Atlantic City Police Department, Atlantic City Police officer Andre L. Corbin, 44, of Northridge Drive, Mays Landing, was arrested without incident in Atlantic City.

Corbin was charged with two (2) counts of Official Misconduct, two (2) counts of Sexual Assault, and one (1) count each of Endangering the Welfare of a Child and Criminal Sexual Contact.
The charges specified that Corbin committed acts related to his office that constituted unauthorized use of his official position as a police officer in order to obtain benefit for himself, specifically sexual acts with a child. The State alleges that, while performing his official duties, Corbin committed the acts against a 16-year-old female victim.
Today, Corbin waived presentation of the case to a Grand Jury and pled guilty to the accusation. In accordance with a plea agreement, Crobin pled guilty before Atlantic County Superior Court Judge Michael A. Donio to (1) one count of Official Misconduct and one (1) count of Sexual Assault—both crimes of the 2nd degree.
Corbin admitted in Court to using Facetime to transmit an image of his penis while in his police uniform, and to meeting the victim between January and August of 2013 and committing sexual assault by oral and digital penetration of the underage female, while being a police officer with supervisory power over the victim.
At the request of the State, Judge Donio signed an order forfeiting Corbin’s current employment as a police officer, and forever disqualifying him from holding any future public office.
A 2nd degree crime carries a potential penalty of incarceration in New Jersey State Prison for 5-10 years.
First Assistant Prosecutor Diane Ruberton represents the State in the case.

MAYS LANDING – A Ventnor man was convicted of murder in Atlantic County Superior Court for the fatal shooting eight (8) years ago of an Atlantic City man, Atlantic County Prosecutor Jim McClain announced.
Today, an Atlantic County jury found Laquay Williams, 36, of Ventnor, NJ, guilty of murder and three weapons possession charges for the 2006 shooting death of Atlantic City resident Jerrod Moss, 20, whose body was found in an Atlantic City parking lot.
On December 29, 2006, after 4:00 a.m., Atlantic City Police and the Atlantic County Major Crimes Unit responded to a New York Avenue parking lot for the report of a shooting. Jerrod Moss was found lying in a parking lot, the victim of a gunshot wound to the head. Moss was pronounced dead at the scene.

On February 14, 2013, at the conclusion of an intensive six-year-long homicide investigation conducted by Major Crimes detectives, Prosecutor McClain authorized charges against Williams for murder, felony murder, conspiracy to commit murder, and weapons offenses.
Williams was served the arrest warrant a week later at New Jersey State Prison in Trenton, where he was serving a prison sentence on an unrelated matter. Atlantic County Superior Court Judge Bernard E. DeLury set bail on these charges at $1 million.
On September 18, 2013, an Atlantic County Grand Jury indicted Williams on four criminal counts: murder, and three (3) weapons offenses.

Today, an Atlantic County jury deliberated for two (2) hours before returning the verdict of guilty on all four criminal charges:
  • Murder, a crime of the 1st degree,
  • Possession of a Firearm for an Unlawful Purpose—a 2nd degree crime,
  • Unlawful Possession of a Weapon—a 2nd degree crime, and Possession of a Weapon by a Convicted Felon—a 2nd degree crime.

Williams remains in custody, and will be sentenced by Judge DeLury on March 5, 2015.
The murder conviction carries a sentence of life imprisonment in State Prison with a minimum of 30 years without parole. Pursuant to the No Early Release Act (NERA), 85% of the sentence must be served before becoming eligible for parole.
The three weapons possession charges are 2nd degree crimes that carry potential penalties of 5-10 years imprisonment.
Assistant Prosecutor Richard McKelvey, who represented the State in the case, said in his closing remarks that Williams, “killed because he thought he could get away with it. Because the code of the streets would protect him.” McKelvey said, “Eight years have gone by, but even when we think we’re through with the past, the past ain’t through with us. And today is about the past coming and calling on” the defendant.

Township Clerk, Officials Under State Investigation For Allegedly Lying About Existence of Records

$

A former New Jersey resident and transparency government activist Harry Scheeler has filed two separate complaints against Acting Clerk Kelli Danieli, Township Solicitor Michael Fitzgerald, and another Attorney assigned to the Township to defend a lawsuit.

The complaints filed with the Government Records Council (GRC), allege the Township violated Scheeler's right under the Open Public Records Act (OPRA) by intentionally withholding a lawsuit settlement agreement made between the Township and former Township Manager Stephen Bonanni. The settlement was approved by Township Council in November 2014 for $92,000.

Scheeler alleges in the complaints that on two separate occasions he filed an OPRA request for the settlement agreement and the Township denied the release of the agreement by continually stating the agreement was never executed, which Scheeler claims the Township lied.

According to the settlement agreement, once released by the Township, Bonanni executed the agreement on November 4, 2014, sixteen days prior to Scheeler's first OPRA request.

On December 22, 2014, Scheeler filed his second OPRA request for the same document and Acting Township Clerk Kelli Danieli responded again stating the agreement had not been executed. Scheeler alleged in his second complaint that the Township again lied and intentionally withheld the document.

Regarding the first complaint filed, Township Manager Susan Jacobucci stated, "there was no basis for the complaint" that was filed by Scheeler.

Township Solicitor Michael Fitzgerald stated, "Pursuant to the instructions of the defense counsel, there were issues which needed to be resolved before the settlement became  final. The document may have been "executed" by Bonanni, but that was only part of the settlement and it remained only tentative until all issues were resolved."

Fitzgerald later stated in an email to Scheeler that the Acting Clerk, "relied upon the prior legal advice that the settlement was not final. Saying that the settlement was "unsigned" was a misunderstanding and wrong, but it wasn't intentional." Fitzgerald further requested Scheeler withdraw his complaint.

A Township Official further acknowledged the dispute between Scheeler and the Township regarding the release of the documents and stated it was their understanding that the Township Solicitor was at fault for the discrepancy and would work towards correctly the issue moving forward.

Scheeler stated, "OPRA has 24 exemptions. Outside of these exemptions the government can not for any reason withhold a document from the public. After confronting the township with the fact I had knowledge Bonanni was in fact paid they finally released the settlement."

"The settlement clearly showed it was in fact executed prior to the dates which I requested them. Had the clerk just denied the document and claimed an exemption this would have been an unlawful denial complaint" Scheeler stated.

Scheeler further stated, "Because the clerk attempted to deliberately conceal the document the GRC must impose a fine which the clerk must pay not the taxpayers. Again we have a situation in Galloway where the government acted inappropriately and instead of just admitting wrong doing they are going to spend tax payer money to defend actions that were not permitted under law."

Scheeler requested the Government Records Council fine any of the parties involved responsible for the deliberate and intentional withholding of the agreement. If the GRC determines any of the parties intentionally violated OPRA and charges a fine, the cost of the fine is $1,000.

Woman Convicted of Vehicular Homicide After 2012 Crash that Killed Husband

MAYS LANDING – A New Hampshire woman was convicted of vehicular homicide in connection with a 2012 single-vehicle crash in Pleasantville that claimed the life of her husband, Atlantic County Prosecutor Jim McClain announced today.
Today, an Atlantic County jury found Allison Hawks Nasta, 31, of the 300 block of Varney Street, Manchester, New Hampshire, guilty of vehicular homicide and two additional charges.
Shortly before 1:00 p.m. on Aug. 28, 2012, Nasta was driving her minivan westbound on the Black Horse Pike between Chestnut Avenue and Route 9 in Pleasantville, when she crossed two lanes of traffic and collided head-on with a utility pole.

Nasta’s husband, William Nasta, 34, who was the front-seat passenger, was transported to the AtlantiCare Regional Medical Center—City Division, where he died of his injuries.
The couple’s two daughters, a 5-year-old and a 3-month-old—who was in an infant car seat—were in the backseat. Allison Nasta and the children sustained non-life threatening injuries and were also transported to AtlantiCare Regional Medical Center— City Campus for treatment.
The investigation of the Atlantic County Prosecutor’s Office Fatal Collision Unit and the Pleasantville Police Department led to Nasta’s arrest the next day at the hospital. Nasta was charged on criminal complaints with operating a motor vehicle while her driver’s license was suspended, resulting in the death of another person, hindering her own apprehension by providing a false name to investigators, obstruction of justice, and with numerous New Jersey motor vehicle law violations, including reckless driving, driving while suspended, and operating a motor vehicle while in possession of narcotics.
Nasta was released on the summon complaints.
On July 31, 2013, as a result of the continuing investigation, Nasta was charged by the Atlantic County Prosecutor’s Office with vehicular homicide, by driving a vehicle recklessly and causing the death of William Nasta.
Bail was set by Atlantic County Superior Court Judge Kyran Connor at $50,000 full cash. Nasta subsequently posted bail, and has been free pending court.
On September 19, 2013, an Atlantic County Grand Jury indicted Allison Hawks Nasta for vehicular homicide and additional criminal counts.

Today, after a six-day trial before Atlantic County Superior Court Judge Albert Garofolo, an Atlantic County Grand Jury returned a guilty verdict for:
  • Vehicular homicide—a crime of the 2nd degree,
  • Operating a motor vehicle while her driver’s license was suspended and causing a motor vehicle accident which resulted in serious bodily injury—a 3rd degree crime, and
  • Possession of heroin—a 3rd degree crime.

Assistant Prosecutor Seth Levy, who represented the State in the case, told the jury during his closing arguments that the State found opiates in Nasta’s system and observed her “21⁄2 hours [after the accident with] red eyes, slurred speech, nodding off.”
Levy said, “I told you that this case was about priorities. About the defendant’s choices: to use drugs, to get high, and to drive...The evidence proves these facts again and again: Allison Nasta got high, drove recklessly—speeding across two lanes of traffic, and did not try to avoid slamming into a pole; in fact, she sped into it.”
After the jury returned its verdict, and upon application by Assistant Prosecutor Levy, Judge Garofolo revoked Nasta’s bail and ordered her taken into custody and housed in the Atlantic County Justice Facility pending sentencing.
A second degree crime carries a potential penalty of incarceration in New Jersey State prison for a period of 5-10 years. The vehicular homicide conviction is subject to New Jersey’s No Early Release Act (NERA), requiring that 85% of the imposed prison sentence be served before becoming eligible for parole. A crime of the third degree carries a potential penalty of 3-5 years in prison.
Nasta will be sentenced by Judge Garofolo on March 6, 2015.
