Over 250 Teachers, Staff Picketed Oakcrest, Absegami to Protest Lack of Contract

More than 250 teachers and educational support professionals in the Greater Egg Harbor Regional High School District, which includes Oakcrest, Absegami, and Cedar Creek high schools, picketed early this morning outside Oakcrest and Absegami high schools to protest the fact that they have been working more than one year without a new contract.

The Greater Egg Harbor Education Association (GEHREA), which represents 435 staff members in the district, have been working without a new contract since July 1, 2015.

Local labor unions honored today’s informational picket line and would not cross the line. The picketing ended at 8 a.m. and provided the association with an opportunity to inform the public about the bargaining crisis in the district by handing out flyers.

In early June, the association accepted the state-appointed fact-finder’s report, asking only to modify the structure of the salary guide, which would not have added a single penny to the fact-finder’s recommendation.

The Board rejected the vast majority of the report, including any recommendations that benefited the staff, and added the new demand that in order to settle the contract, the association had to drop any pending grievances and arbitrations.

Since the 2014-15 school year, there have been 11 grievances and arbitrations filed against the district as a result of administrative decisions that violate the contract and/or the law. In the 30 years prior, there had been less than five grievances total filed in the Greater Egg Harbor Regional School District.

In another sign of the Board and administration’s disrespect for staff and the law, is the district’s refusal to file jointly with the association for super-conciliation with the state’s Public Employment Relations Commission (PERC), even though the legal process mandates that super-conciliation is the final step in the negotiations process to resolve the bargaining crisis.

The bargaining crisis is reaching a critical point in the district and more actions by the association are being planned.

GEHR School Board Answers Public Concerns on Oakcrest Principal by Remaining Silent and Not Voting

After a two-hour long Donaldson hearing that was held on July 5th, Greater Egg Harbor Regional School Board led by Board President Carol Houck remained silent by opting not to vote on overriding the Superintendent's recommendation to not offer former Oakcrest Principal Joe Carruth a renewal in contract.

Superintendent John Keenan recommended that Carruth not receive a new contract for unknown personnel reasons. At Carruth's request the hearing was held in public where over thirty teachers, parents, students, elected officials and residents spoke in support of Carruth.

Chip Kraybill of the NJPSA represented Carruth at the hearing. Kraybill outlined what was a great start of the year for Carruth when his employment took an unexpected unanswered turn.

Many students and parents described Carruth as a leader, friend and a principal that made Oakcrest High School a safe place to be.

None of the Board members including Superintendent John Keenan spoke at the hearing.  All questions to the board were directed to the Board Solicitor Louis Greco, Esq. who stated, "the Board ultimately makes the decision to accept the Superintendent's recommendation."

However, according to the rules that govern Donaldson Hearings provided by the Board Solicitor, "the board can override the CSA's recommendation not to renew, and can vote to offer the employee a contract."

According to those same regulations,"the board is not obligated to take a vote after the informal appearance (Donaldson hearing.) If the board does not vote, and the CSA has made a recommendation not to renew, the CSA's recommendation not to renew will stand."

In this case, the Board voted to go into private executive session to deliberate which was publicly disputed by several people, including the Publisher of this website as a violation of the Open Public Meetings Act since Carruth requested his personnel discussion to be public. The Board left the meeting under opposition and scrutiny only to return 10-minutes later stating they did not hold executive session and came back to the public only to vote to adjourn the meeting.

Since a vote on Carruth's employment did not occur the Board now must notify the employee within three-days following the informal hearing of the Board's decision. It appears the silence of the Board was the ultimate decision to not address the public appeals and further affirm the dismissal of Carruth from his post. After the meeting Carruth stated, "I am looking at all legal options available to me."

Galloway Mayor Don Purdy addressed the Board Solicitor regarding his behavior towards the residents, parents and most importantly the students. Purdy described the Solicitor's behavior as disrespectful and stated the Board was making a mockery of the School District. The Board Solicitor later apologized to Mayor Purdy after the meeting.

Purdy stated the only way to change is to vote the Board out.  Board Members Carol Houck and Vicki Hood which represent Galloway Township seats are both up for re-election this year. Two new candidates will face-off against Houck and Hood for those seats this November.

Galloway Resident Among Those Charged with Illegal Drug Trafficking in Atlantic City Area

ATLANTIC CITY – A joint investigation conducted during the past year by the Atlantic County Prosecutor’s Office, the Atlantic City Police Department, the New Jersey State Police, the New Jersey Office of the Attorney General Atlantic City Task Force, and the Federal Bureau of Investigation (FBI), culminated yesterday in criminal charges against 41 members of a significant illegal drug trafficking organization operating in the Atlantic City area, the arrests of 19 of those charged, and the seizure of large amounts of illegal drugs, money, motor vehicles, and handguns, Atlantic County Prosecutor Jim McClain announced today.
Early yesterday morning, Thursday, July 7, 2016, Detectives of the Atlantic County Prosecutor’s Office, the Atlantic City Police Department, the New Jersey State Police, the Attorney General Atlantic City Task Force, and the FBI—armed with State and Federal arrest warrants, and assisted by law enforcement officers of local, regional, State, and Federal agencies, including multiple tactical teams—arrested 19 individuals in Atlantic County. Law enforcement continues to pursue the arrests of the 22 others charged with crimes in this case.

Two of the individuals arrested yesterday, Diaab Siddiq, a.k.a. Marshall Davis, 47, of Green Street, Atlantic City, and Ameer Stephens 36, of Genista Avenue, Galloway Township, have been charged under New Jersey law as a leaders of a narcotics trafficking network.
Detectives, police officers, and agents simultaneously executed 19 search warrants for residences and commercial properties in various locations throughout the County in Atlantic City, Galloway Township, Egg Harbor Township, Hamilton Township, Hammonton, and Pleasantville, and executed warrants for the search and seizure of 11 motor vehicles.
These search warrants resulted in the seizure yesterday of 12,225 bags of heroin, approximately 8 ounces of raw, unpackaged heroin, 8 ounces of suspected fentanyl, and 1 kilogram of cocaine.
Police also seized drug packaging materials, drug paraphernalia, 3 handguns—one with an illegal magazine with the capacity to hold 25 rounds of ammunition—, firearm ammunition, $73,884.00 in U. S. currency, and 11 motor vehicles.
During the investigation phase of the operation—prior to yesterday’s raids—law enforcement seized an additional 8,660 wax-fold bags of heroin, approximately 6 ounces of cocaine and 4 ounces of raw, unpackaged heroin, over $80,000 in U. S. currency, and 3 more handguns, bringing the totals seized by law enforcement during the investigation and execution of arrest and search warrants to: over 20,000 bags of heroin, approximately 12 ounces of raw, unpackaged heroin 8 ounces of suspected fentanyl, and 1.25 kilograms of cocaine, 6 handguns, and over $155,000 in U. S. currency.
The estimated total street value of the narcotics seized during the investigation and during yesterday’s warrant execution is nearly a half million dollars ($500,000).
As a result of an investigation initiated by the Atlantic City Police Department, the State alleges that this drug trafficking organization has been distributing large quantities of heroin and cocaine in the Atlantic City area.
In addition to members of the five agencies who conducted this joint investigation, law enforcement agencies that assisted in yesterday’s operation included the municipal police departments of Brigantine, Buena Borough, Egg Harbor Township, Galloway Township, Hamilton Township, Hammonton, Linwood, Northfield, Longport, Pleasantville, Somers Point, and Ventnor, the Atlantic County Sherriff’s Department, the Atlantic County Corrections Department, the Cape May, Cumberland, and Ocean County Prosecutor’s Offices, New Jersey State Parole, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), Homeland Security Investigations (HSI), and tactical and SWAT teams of the Atlantic City Police Department, Atlantic County Regional SWAT, NJSP TEAMS Unit, FBI Tactical Team, and the Cape May County Tactical Entry Team.
All of the arrests, executed in various locations in the County, were made without incident.
Prosecutor Jim McClain said, “This enforcement action is important also in continuing the series of joint municipal, County, State, and Federal investigations in recent years which have dismantled other criminal organizations in and around Atlantic City, preventing this narcotics organization from filling the void left by the arrests and prosecutions of members of those organizations.” Prosecutor McClain emphasized that “all levels of law enforcement in the Atlantic City Area remain committed to working together to effectively and efficiently address the heroin epidemic in New Jersey, as well as other types of criminal activity.”

What follows below is a list of all 41 charged defendants, their ages, genders, and home addresses. The names of the 19 persons who were arrested yesterday and are now in custody are identified with a checkmark before the name, and listed in bold and underlined font: Name of Defendant. The arrests of the remaining 22 defendants by law enforcement are pending.

A conviction for a 1st degree crime carries a potential penalty of 10-20 years of incarceration in New Jersey State prison. The potential penalty for a 2nd degree conviction is 5-10 years of imprisonment.
Diaab Siddiq and Ameer Stephens, charged under New Jersey law as leaders of a narcotics trafficking network, face a possible sentence of life in prison without becoming eligible for parole until after having served 25 years in prison.

This year Galloway Township voters will see the names of Michael T. Baldwin, Sr. and Lisa Tilton on the ballot for General Election in November and Hamilton Township voters will see the name of Thomas Dawson Jr. on their November ballot.

Baldwin, Tilton and Dawson are running with one mission in mind; to bring Strength, Ethics, Integrity and Transparency back to the Regional School Board.  The students should be honored for their achievements and success and their education has to be top priority.

Baldwin, Tilton and Dawson also believe the residents need a safe school environment that protects the health and well-being of all the students and staff. They will bring open communication and discussions with the parents and guardians on students progress, development and success.

Most importantly Baldwin, Tilton and Dawson will bring the strength back to the Regional School Board and restore order and control with the Board, where it belongs.

Greater Egg Harbor School Employees Open Crisis Center; Super-Conciliator Appointed

Frustrations continue to grow as it appears that school employees may soon begin their second school year with no contract.

The 435 affected employees, including teachers and support staff personnel that work at Oakcrest, Absegami and Cedar Creek High Schools, are represented by the Greater Egg Harbor Regional Education Association.

Talks in the District have not resulted in a new contract in spite of numerous negotiation sessions, mediation sessions with a state appointed mediator and fact-finding with a state appointed fact-finder. The 109 page report issued on June 3 by the impartial fact-finder following a nine hour hearing and post hearing briefs contained non-binding recommendations for settlement.

The Association accepted the recommendations in its totality with only a minor revision to the structure of the salary guide which did not add one cent to the cost. The vast majority of the report’s recommendations were rejected by the Board with the exception of certain recommendations which favored the Board.

On Thursday, the Association opened a “Crisis Office” on Philadelphia Avenue in Egg Harbor City. Stephanie Tarr, President of he Association stated “At this point in time no formal vote on a work stoppage has yet been taken.

However, the Association is keeping all of its options open and is not excluding a possible work stoppage. While the disruption of services is the very last thing our members want to do, the Board has maintained its position in these negotiations of what amounts to a significant reduction in the overall salaries of our members and a diminution or benefits and working conditions.

The Board’s offer does not even allow for the 2013-2014 salaries to be maintained. This is totally unacceptable to our members especially when other districts in the County are reaching fair and equitable agreements.” Tarr stated.

While no formal strike vote has yet been taken, staff members have been wearing buttons that state “8/30”.  Tarr would not offer any explanation as to the significance of that number except that August 30 is the first student day of school in the district.

The state recently appointed Martin Scheinman, Esq., a nationally renowned mediator and arbitrator as the “super-conciliator” who will attempt to assist the parties in reaching a settlement.

Myron Plotkin, the NJEA representative representing the Association, said that the parties were unable to mutually agree on a “super-conciliator” and following the Board’s refusal to file a joint request with the Association to the State, the Association filed the request on its own.

Mr. Scheinman is a renowned and well respected mediator/arbitrator and has vast experience is resolving difficult labor disputes. He has arbitrated or mediated over 10,000 disputes throughout the United States.  “A “super-conciliator” can order the parties to meet acceptable super-conciliator the clock in order to reach a settlement. He can also write a recommendation for a settlement. However, that recommendation is not binding on the parties.

The Association hopes that Mr. Scheinman’s  experience and his abilities at persuasion will result in a fair and equitable settlement.” Plotkin said.  “This is the last step in the formal negotiations process. If no settlement can be reached, then it will be left up to the Association to determine what future actions may be taken.”

According to Plotkin, the Association has and will continue to make every attempt to resolve the dispute. “The Association accepted the fact-finder’s recommendations even though there were some there were some we were not happy with.

The Board basically rejected all recommendations that favored the Association.” Plotkin said “The Association is attempting to reach a fair and equitable settlement just like other districts have done in Atlantic County.  If other districts can negotiate in good faith and reach agreements in these economic times, we see no reason why this Board is any different. We only want what is fair.”

On July 5th, Association members set up informational picket lines at Oakrest and Absegami High Schools. Union construction workers working at the two schools did not cross the picket lines and did not report for work until after the Association’s lines had come down.

While no exact date has been set for a meeting with the super-conciliator, Tarr stated “Hopefully a settlement can be reached during super-conciliation. We are prepared to spend the entire night, if necessary to reach a fair deal. We are doing and will continue to do all within our power to resolve this dispute without any need for any disruption, however, our patience is running thin and we need to bring closure to this dispute and will not allow it to continue to drag on. We want to be able to return to what we do best, teach and care for the children.”
